Camper Trailer Hire

Camp Out Pty Ltd Camper Trailer and Camping Equipment Hire Agreement

  1. The owner will Hire the Item(s) in this contract to the Hirer and at no time does the Hirer act as the Owners agent or assume ownership and/or title of the aired equipment
  2. The Hirer shall pay a deposit of $200.00 or other amount agreed as a booking fee on booking and the balance of hire fee is to be paid not less than three (3) weeks prior to agreed date or commencement.If such payment is not received at least three (3) weeks before the agreed hire date then this will be deemed a cancellation and no refund will be made to the Hirer unless a suitable replacement booking can be found.
  3. Should a cancellation be made for any reason in the two (3) weeks before the agreed date then the Owner will endeavour to rehire the item(s) on the same terms and conditions.
  4. There will be no refund for goods returned earlier than that noted on the contract.
  5. A security bond of $500.00 will be paid at time of pick up. This deposit will be held until an inspection of the goods hired can be completed. The Owner may refund the security bond within three (3) working days thereafter upon finding no damage or loss of equipment and the equipment is returned in a clean state.
  6. In the event of any loss of items or damage (fair wear and tear excepted) being found, the Owner will deduct the cost of repair or replacement of lost goods from the bond at the Owners cost price.
  7. A further cost will be charged if the hire items are returned in an unclean or unfit condition. This fee will be deducted from the security bond (the Owners discretion).
  8. By taking delivery of the equipment and signing the contract the Hirer has satisfied himself as to the condition of the equipment and as to its suitability for us intended purpose and acknowledges receiving this equipment in good order
  9. The Hirer is responsible for ensuring goods/equipment are kept securely and undamaged until return or actually collected. All goods/equipment hired is done so at Hirer's risk. The Hirer will pay an excess of $1000.00 for each and every claim made for accidental damage or theft of any equipment in his possession for the period of the contract.
  10. INDEMNITY The Hirer shall indemnify and keep indemnified and save harmless the Owner and the Owner's servants and agents from all damages, writs, actions, claims and demands of every description whatsoever and howsoever arising either directly or indirectly from the use, maintenance, transport, operation of the goods or otherwise.
  11. EXCLUSION OF LIABILITY The Owner shall not be liable to the Hirer or the Hirer's servants or agents from any damages, suits, actions, claims and demands of every description whatsoever and howsoever arising either directly or indirectly from representations, warranties, terms and conditions express or implied (except in so far as statutory conditions and warranties cannot be excluded under Part V Division 2A of the Trade Practices Act (1974) or relevant State Legislation), use, maintenance, transport, operation of the goods or otherwise.
  12. OPERATION OF CLAUSE Clauses 14 & 15 hereof to the extent that are inconsistent with other clauses, terms or condition of the Agreement are to override such clause and be of paramount force.
  13. In this "Hire Agreement" the word "owner" means "the owner or his agent" and the word "camper trailer" means "camper trailer and all equipment attached thereto or hired under this Agreement".
  14. The Hirer shall take good care of the equipment keep clean and in good repair and condition (reasonable wear and tear excepted) and is fair for proper care and maintenance in accordance with verbal or written instruction given to him by the Owner, including but not limited to trailer lights, greasing and keeping the tyres inflated to recommended levels.
  15. If the Hirer does not return the camper trailer and goods within 24 hours of the expiration of the hire period in this contract (or does not notify the Owner of delay of return) the goods will be deemed to have been appropriated and will be reported to the Police as stolen. Any cost incurred by the Owner in recovery of the said goods will be payable by the Hirer.
  16. Any delay in returning the hired goods will incur extra charges at the hiring rate.
  17. The law of New South Wales Australia shall apply to this agreement in all circumstances.
  18. For the purposes of this contract a Weekend will be deemed to be eg. Friday pm pickup and Sunday pm return, a Week will be deemed to be seven (7) consecutive days (eg. Sunday to Saturday).
  19. If the Hirer is involved in an accident causing damage to any hired goods the Hirer must notify the Owner forthwith and the Hirer accepts full responsibility of notification and all other requirements of the Owner's insurers, to enable a claim to be made and the Hirers security bond will remain held and be provided as part of the insurance excess. The Hirer may elect to pay for damages if the claim is less than the insurance excess. All parts and labour will be equivalent to Owners cost.
  20. If the Hirer wished to take the hired goods to any other destination other than noted in this contract, the Hirer must notify the Owner immediately or the Hirer will be in breach of this contract and the Item(s) must be returned forthwith to the Owner.
  21. A11 warranties and conditions other than these expressed in this agreement are hereby expressly excluded.
  22. The Hirer may make no modification or effect any repair save with the Owners prior written consent.
  23. The Hirer agrees at all times to permit the Owner access to inspect and/or repair the hired goods.
  24. The Owner shall not be responsible to the Hirer in anyway for any items being unavailable at the commencement of the hire and in that event the contract shall be at an end and the Owner shall refund all hire fees paid by the Hirer without deduction.
  25. The Hirer will indemnify the Owner against all actions, claims and expenses, arising out of the condition of the equipment or manner in which it was used whether caused by the negligence of the Hirer or his servant or agents or by the negligence of any other person whatsoever.
  26. The Hirer shall comply with all legal requirements of all government authorities related to the use of the goods
